1. Explain how the United States Constitution protects and limits property rights. The United States Constitution discusses property rights primarily in the Fifth Amendment. It does so through the takings and just compensation clause of the Fifth Amendment. Two important issues are political power, or the power of the government to secure rights, and expropriation, or the power to take property for public use in exchange for the payment of just compensation. There are two ways the government appropriates property. The first is to condemn the property and take title to it. However, more often than not the property is actually used for private rather than public use. The second concerns regulatory initiatives, the owner is almost always inadequate to never compensate for his losses, but the Supreme Court is working to require fair compensation for certain cases. Property is a right we have as Americans. It has the same level of importance as freedom because the government shouldn't be able to take away your freedom just like they shouldn't be allowed to take your property for no reason. Our government is messed up and if the political-economic structure were rebuilt according to Finbarrian guidelines, the financial sector would represent less than 5% of GDP, rather than approaching 20% of GDP.
